General terms and conditions (GTC)
Effective: 30. September 2026
These general terms and conditions (“GTC”) govern the booking and use of rooms via the elu rooms platform, an offering of Elevate You GmbH based in Vienna, Austria (“elu rooms”). Completing a booking concludes a usage agreement directly between the person booking (“booker”) and elu rooms.
§ 1 Scope and provider
- These GTC apply to all bookings and use of rooms offered via the elu rooms platform.
- The provider is Elevate You GmbH, Petrusgasse 16/1, 1030 Wien, Österreich, FN 688469f, E-Mail info@elevateyou.app.
§ 2 Parties to the usage agreement
- elu rooms rents the rooms offered on the platform itself and sublets them hourly, half-day, or full-day to bookers in its own name and for its own account (“usage agreement”). elu rooms is not an intermediary between a room owner and the booker; elu rooms is itself a party to the usage agreement.
- elu rooms provides its own equipment in the rooms. This equipment is part of the booked service.
§ 3 Service
- elu rooms offers bookable, equipped rooms for professional use, in particular physiotherapy, massage, training, consulting, and coaching.
- The current offering comprises two rooms in Vienna: Petrusgasse 16, 1030 Vienna, and Cottagegasse 65, 1190 Vienna.
§ 4 Conclusion of contract
- Rooms can be booked in three ways: hourly, half-day (morning or afternoon), and full-day.
- Bookings are possible until 24 hours before the intended start of use.
- Available times can be booked immediately and bindingly; no separate confirmation by elu rooms or a third party is required.
- The usage agreement is concluded when the booking is completed and the booking amount has been paid in full.
§ 5 Prices and payment
- All prices shown to bookers are gross, including statutory VAT.
- Pricing is based on the hourly rate set for the respective room.
- Half-day booking (morning or afternoon): hourly rate × booked hours, minus 10%.
- Full-day booking: hourly rate × booked hours, minus 20%.
- The full booking amount is due immediately when the booking is completed and is processed online via the payment methods offered on the platform.
- Because elu rooms is a party to the usage agreement, elu rooms issues the invoice to the booker.
§ 6 Access to the rooms
- Access is provided, depending on the location, via a key box or a digital access system (Nuki).
- Access details are sent electronically no later than 24 hours before the booked use begins.
- Entry is permitted only during the booked period.
§ 7 Cancellation, no-show, and withdrawal
- Distance contracts with consumers generally include a statutory right of withdrawal under § 11 FAGG. Bookings via elu rooms are services related to leisure activities for a specific date or period. For such contracts there is no statutory right of withdrawal under § 18 (1) no. 10 FAGG. The following cancellation rules apply instead.
- Cancellation is free of charge until 24 hours before the booked start of use.
- Because bookings can only be made until 24 hours before the intended start, a booking is generally binding once completed; free cancellation after that is usually no longer possible.
- In case of a no-show, the full booking price remains due; there is no refund.
- In justified exceptional cases (for example documented illness or force majeure), elu rooms may consider a goodwill solution on request.
§ 8 Room usage terms (house rules)
Use of the rooms is also subject to the separately provided room usage terms (house rules) of elu rooms as amended. They are made available to bookers no later than with the booking confirmation and form a binding part of the usage agreement.
§ 9 Warranty and liability
- The statutory warranty rules apply.
- elu rooms is fully liable for intent and gross negligence and for harm to life, body, or health.
- For slight negligence, elu rooms is liable for property damage only if essential contractual duties are breached; liability is then limited to the typically foreseeable damage.
- Bookers are liable under statutory rules for damage caused by improper use of the room or the provided equipment.
- Bookers remain solely responsible for their own professional work with clients and for their own professional/business liability insurance; this is not part of the service provided by elu rooms.
§ 10 Data protection
Personal data related to the use of elu rooms is processed in accordance with the privacy policy available at /datenschutz.
§ 11 Dispute resolution
The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. The email address of elu rooms is info@elevateyou.app. elu rooms is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Changes to these GTC
elu rooms may change these GTC for the future. Users will be informed of material changes by email in good time before they take effect. Bookings already concluded remain subject to the GTC valid at the time of that booking.
§ 13 Final provisions
- Austrian law applies, excluding conflict-of-law rules and the UN Sales Convention. If the booker is a consumer habitually resident in another EU member state, that state’s mandatory consumer protection rules remain unaffected.
- Actions against consumers may only be brought at the court of their place of residence. Consumers may sue elu rooms at its registered office or at their own place of residence. For business customers, Vienna is agreed as the place of jurisdiction.
- If a provision of these GTC is or becomes invalid, the remaining provisions remain in effect.
The room usage terms form a binding part of these terms and conditions.
